MyTutorElite Terms and Conditions

Definitions and Interpretation​

  • “MyTutorElite” refers to David Bell Educational Ltd., trading as MyTutorElite.

  • “Client” means the individual or entity requesting Tuition, presumed to be the person who initially contacts MyTutorElite unless otherwise agreed in writing.

  • “Lesson” means a scheduled period during which Tuition is provided by the Tutor to the Client, subject to payment.

  • “Lesson Fee” means the total charge payable for a Lesson, comprising the Tuition Fee and any applicable Travel Expenses.

  • “Travel Expenses” means any costs incurred by the Tutor for travel to and from the Lesson venue, applicable solely to face-to-face Tuition.

  • “Tuition” means any educational service provided by the Tutor as requested by the Client.

  • “Tuition Fee” means the fee charged specifically for the provision of Tuition during a Lesson.

  • “Tutor” means the individual engaged to provide Tuition and entitled to receive payment therefor.

By engaging TutorElite’s services, the Client agrees to be bound by these Terms and Conditions.

Lesson Cancellation

  1. The Client must provide at least 24 hours’ notice for cancellation of a Lesson. Failure to do so, except in cases of accident or emergency, shall render the Client liable for a cancellation fee equal to the Lesson Fee, unless otherwise mutually agreed in writing by the Tutor and Client.

  2. For cancellation of group classes or sessions held at physical locations (including but not limited to Mock 11+ tests), the following refund policy applies:

    • Cancellation more than 14 days prior to the session: full refund.

    • Cancellation between 7 and 14 days prior: 50% refund.

    • Cancellation within 7 days of the session: no refund, although an alternative session may be offered at TutorElite’s discretion and subject to availability.

  3. In the event the Tutor cancels a Lesson with less than 24 hours’ notice, except for accident or emergency, the Client shall be entitled to receive a replacement Lesson of equivalent duration scheduled at a mutually convenient time.

  4. Lessons are expected to be undertaken regularly, with a minimum frequency of once per week. The Client shall inform MyTutorElite of any planned absences or holidays sufficiently in advance to mitigate cancellation charges.​

Payment Terms

  1. The Client shall remit payment of the Lesson Fee either to MyTutorElite or directly to the Tutor, as per the arrangement agreed at the outset of engagement. In the absence of such an agreement, payment shall be made directly to the Tutor.

  2. Where payment is made to MyTutorElite, an invoice will be issued detailing the sum due. The Client agrees to settle the invoice in full by the specified due date.

  3. For pay-as-you-go arrangements involving payment to the Tutor, the Client must make payment prior to the commencement of each Lesson, unless otherwise expressly agreed in writing.

  4. Failure to pay any amounts due by the specified due date shall entitle MyTutorElite to levy:

    • A late payment fee of up to £10 per written reminder, with reminders issued no more than once per calendar month.

    • Interest on overdue sums at the rate of 8% per annum above the Bank of England base rate, accruing daily until payment is received.

  5. In the event of any dispute concerning the Lesson Fee, the hourly rate confirmed to the Client upon provision of Tutor details shall prevail.

  6. MyTutorElite reserves the right, at its sole discretion, to apply a reasonable surcharge to cover Travel Expenses incurred for face-to-face Tuition.

  7. Discounts offered for lesson bundles are granted at the sole discretion of MyTutorElite.

  8. Upon cancellation of bundled Lessons:

    • Cancellation up to and including the third Lesson shall entitle the Client to a refund of all remaining Lessons, less payment for completed Lessons at the agreed hourly rate.

    • Cancellation after the third Lesson shall be subject to refund only at MyTutorElite’s discretion.

  9. Additional Lessons booked beyond a bundle shall be charged at the discounted rate applicable to the bundle purchased.​

Miscellaneous

  1. MyTutorElite reserves the right to require any Tutor to cease providing Tuition to a Client at any time, at its sole discretion.

  2. The Client shall not engage any Tutor directly or indirectly without the express prior written consent of MyTutorElite.

  3. Upon request, the Client shall provide MyTutorElite with details of all Lessons conducted by the Tutor.

These terms and conditions are governed by the laws of England and Wales and any dispute arising out of or in connection with them shall be subject to the jurisdiction of the courts of England and Wales.
